Sendvio Acceptable Use Policy (AUP)

This Acceptable Use Policy ("AUP") forms part of Sendvio's Terms and Conditions of Service, Privacy Notice, and Data Processing Agreement (DPA) (collectively, the "Agreement").

By installing or using Sendvio ("Services"), you agree to comply with this AUP. Violations may result in suspension, restriction, or termination of Services without liability to Sendvio.

1. Purpose

This AUP is designed to:

  • Protect Sendvio, its customers, and recipients from spam, abuse, illegal content, and regulatory risk.
  • Ensure compliance with all applicable privacy, data protection, and communications laws worldwide.
  • Give Sendvio clear enforcement rights if your use of the Services is unlawful, abusive, or harmful.

2. Prohibited Content & Activities

You may not use the Services to transmit, store, publish, or promote content that is illegal, harmful, deceptive, or otherwise prohibited. This includes but is not limited to:

  • Unsolicited or Unlawful Messaging ("Spam")
    • Sending messages without valid consent or legal basis under GDPR, LGPD, PECR, UK PECR, CCPA/CPRA, CASL, CAN-SPAM, TCPA, Australia's Spam Act 2003, or any similar laws.
    • Failing to provide required opt-out or unsubscribe mechanisms in messages.
    • Using misleading headers, false sender IDs, or deceptive subject lines.
  • Phishing, Fraud & Misrepresentation
    • Impersonating another entity, deceiving recipients, or unlawfully collecting credentials or funds.
  • Malware & Security Threats
    • Uploading or distributing viruses, spyware, ransomware, or code that interferes with system integrity.

  • Illegal or Regulated Content
    • Promoting or distributing products/services prohibited under applicable law (illegal drugs, unlicensed financial products, weapons, counterfeit goods, unapproved medical devices, gambling in restricted jurisdictions).
  • Hate Speech & Harassment
    • Content that incites violence, discrimination, or harassment against protected groups.
  • Children's Data
    • Collecting or processing data about individuals under 18 (or the age of majority where higher) in violation of applicable laws.
  • Sensitive or High-Risk Data
    • Inputting or processing "special categories" of personal data under GDPR Art. 9 (health, biometric, genetic, political opinions, union membership) or equivalent without a lawful basis and Sendvio's explicit written consent.
  • Sanctions & Export Controls
    • Using the Services in violation of U.S. OFAC, EU, UK, UN, or other international sanctions laws, or exporting Services to prohibited jurisdictions.
  • Automated Dialing / SMS & WhatsApp
    • Using auto-dialers, robocalls, or any automated messaging prohibited under the U.S. TCPA, Canada's CRTC rules, or equivalent laws without explicit prior express consent.

3. Customer Responsibilities

  • Lawful Basis: You are solely responsible for ensuring all subscribers and recipients have given valid consent or other lawful basis for messaging.
  • Transparency: You must clearly identify yourself in your communications and provide a working opt-out mechanism.
  • Compliance with Third-Party Rules: You must comply with WhatsApp Business Policy, Meta template rules, carrier guidelines, and any third-party integration policies.
  • Accuracy: You must ensure the accuracy of all data you upload to Sendvio.
  • Security: You must secure your credentials, accounts, and integrations. Any unauthorized access resulting from your negligence is your responsibility.

4. Sendvio's Enforcement Rights

Sendvio reserves the right, in its sole discretion and without liability, to:

  • Monitor: Review and monitor activity for compliance with this AUP.
  • Suspend or Terminate: Immediately suspend or terminate Services (in whole or part) if you violate this AUP or applicable law.
  • Block or Quarantine: Block content, campaigns, or accounts suspected of violating this AUP or harming Sendvio's infrastructure or reputation.
  • Report to Authorities: Report unlawful conduct to regulators, carriers, Meta, law enforcement, or affected third parties.
  • Recover Costs: Seek reimbursement from you for regulatory fines, penalties, damages, and costs (including legal fees) incurred due to your violation of this AUP.

5. No Circumvention

You may not:

  • Create multiple accounts to evade restrictions.
  • Use proxies, relays, or sub-accounts to mask the true origin of messaging.
  • Interfere with Sendvio's security, rate limits, or abuse detection mechanisms.

6. Geographic & Jurisdictional Compliance

This AUP applies globally. Your obligations include, but are not limited to:

  • EU/EEA & UK: GDPR, UK GDPR, PECR, ePrivacy Directive.
  • US: CAN-SPAM, TCPA, CCPA/CPRA, state privacy laws (e.g., Colorado, Virginia, Utah).
  • Canada: CASL, PIPEDA.
  • Brazil: LGPD.
  • Australia: Privacy Act 1988, Spam Act 2003.
  • Other Regions: Any local anti-spam, privacy, or telecommunication laws.

You are solely responsible for knowing and complying with laws applicable to your recipients' locations.

7. Updates to this AUP

Sendvio may update this AUP from time to time. Material changes will be communicated via in-app notice, email, or website update. Continued use of the Services after updates constitutes acceptance.
